Terms of Service

By accessing or using Portnix services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Portnix provides import compliance documentation services, including but not limited to: • Importer bond qualification preparation • Risk pre-screening for importers • Broker-ready importer package preparation • Broker and underwriting coordination support We do not operate as a licensed customs broker and do not sell customs bonds directly. Our services are designed to help importers prepare documentation for broker and underwriting review.

When using our services, you agree to: • Provide accurate and complete information • Maintain the confidentiality of any account credentials • Notify us immediately of any unauthorized access • Use our services only for lawful purposes • Not misrepresent your business or import activities • Cooperate with our documentation requests

You are responsible for the accuracy of all information and documents you provide to us. While we organize and review documentation, we rely on the information you supply. We are not responsible for any issues arising from inaccurate or incomplete information provided by you.

Our services are advisory and documentary in nature. We do not: • Guarantee approval of customs bonds • Make decisions on behalf of customs brokers or underwriters • Provide legal advice • Represent clients before government agencies • File customs entries or other regulatory documents Final decisions regarding bond issuance, broker acceptance, and customs clearance are made by the relevant licensed parties.

Service fees are quoted on a per-engagement basis. Payment terms are specified in individual service agreements. We reserve the right to modify our fee structure with reasonable notice to clients.

We treat all client information as confidential and will only share it as necessary to provide our services, as authorized by you, or as required by law. See our Privacy Policy for detailed information about how we handle your data.

All materials, templates, processes, and methodologies developed by Portnix remain our intellectual property. You may use deliverables we create for you for their intended purpose but may not resell, redistribute, or claim ownership of our proprietary methods.

To the maximum extent permitted by law, Portnix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid for the specific service giving rise to the claim.

You agree to indemnify and hold harmless Portnix, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of another party.

Either party may terminate the service relationship with written notice. Upon termination, you remain responsible for any outstanding fees, and we will return or destroy your confidential information as directed, subject to legal retention requirements.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

We reserve the right to modify these terms at any time. We will notify clients of material changes. Continued use of our services after changes constitutes acceptance of the modified terms.
